Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Questfully does not warrant that the Services will be uninterrupted, secure, error-free, or that defects will be corrected. We make no guarantees regarding the accuracy, reliability, or completeness of any content or information provided through our Services.
To the maximum extent permitted by applicable law, Questfully and its owners, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
In no event shall Questfully's total liability to you for all claims arising from or related to the use of our Services exceed the amount you paid to Questfully, if any, during the twelve (12) months prior to the claim, or $10 USD, whichever is less.
This limitation applies regardless of the legal theory on which the claim is based, including contract, tort, negligence, strict liability, or any other basis, even if Questfully has been advised of the possibility of such damage.
You expressly understand and agree that your use of our Services is at your sole risk. You assume full responsibility for any decisions, actions, or outcomes resulting from your use of our Services. Questfully shall not be held responsible for any consequences arising from your reliance on any content, feature, or functionality of our Services.
You agree to defend, indemnify, and hold harmless Questfully and its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through our Services.
We reserve the right to modify, suspend, or discontinue any part of our Services at any time without notice or liability. We may also update these Terms from time to time. Continued use of our Services after any changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
